1. Membership & Eligibility

The O’CLUB Program is a free rewards program offered by Oatbox to its customers located in Canada and in the U.S. Membership to the Program is limited to individuals only and is limited to one account per individual. Employees, officers, directors, agents and representatives of Oatbox and its affiliates are eligible for Membership but may be excluded from certain promotions. You must be a legal resident of Canada or the United States to be eligible for Membership. Eligible minors must obtain their parent's or legal guardian's consent prior to participation.

BY SUBMITTING AN APPLICATION FOR MEMBERSHIP IN THE PROGRAM, YOU AGREE (OR, IF YOU ARE A MINOR, YOUR PARENT OR LEGAL GUARDIAN AGREES) TO BE BOUND BY THESE TERMS AND CONDITIONS ("TERMS"). NO PURCHASE IS NECESSARY TO BECOME A MEMBER OF THE O’CLUB.

There is no loyalty card linked to the O’CLUB. It is an online rewards program only. 

 

2. Earning and Redeeming Program Rewards

There are four levels of membership in the Program: O’Original, O’Amateur, O’Gourmet and O’VIP. All members are automatically O’Original upon enrollment. Achieving O’Amateur, O’Gourmet or O’VIP status requires accumulating points, as explained below.

Under the Program, for every Canadian or U.S. dollar spent (as applicable based on country of purchase) on Oatbox merchandise online at www.oatbox.com, you will receive 1 point as an O’Original, O’Amateur, O’Gourmet or O’VIP when you provide or check out with the email address that is registered to your Oatbox account. For every review on a purchased product, you will receive 5 points. For every person you refer, you will receive 100 points at the time of his subscription.  

Are excluded from the Program gift card purchases, taxes and shipping.  

You can view your current point balance, as well as any point activity in your Oatbox account. To view your balance online, simply log in to your online account. Your O’CLUB page is your destination for everything O’CLUB related including your year-to-day activity or current points balance.

Rewards can only be shipped to addresses in Canada or the United States.

Points have no cash value and can only be redeemed for Rewards. Points are never redeemable for cash, for another product (unless expressly permitted by Oatbox), for e-gift certificates and cannot be used as payment.

 

3. O’Original

O’Original status is conferred to those registered as O‘CLUB members. You are automatically an O’Original if you have or when you create your Oatbox account. No points are required to join this level. Oatbox may, in its sole discretion, alter, limit, or modify the O’CLUB rules, regulations, benefits, eligibility for membership, or any other feature of the O’Original tier or may terminate the O’Original tier at any time in its sole discretion, without prior notice. 

As part of the tier benefits, O’Original members receive $2.00 for every order placed by a friend referred. Other tier benefits and rewards can be found by visiting: oatbox.com/en/loyalty



4. O’Amateur

O’Amateur status is conferred on those registered O‘CLUB members who earn a minimum of 300 points by spending money on Oatbox products online, by referring friends and by leaving a review on one of the products bought. Members receive a tier celebration gift when they qualify for O’Amateur. Oatbox may, in its sole discretion, alter, limit, or modify the O’CLUB rules, regulations, benefits, eligibility for membership, or any other feature of the O’Amateur tier or may terminate the O’Amateur tier at any time in its sole discretion, without prior notice.

As part of the tier benefits, O’Amateur members receive $2.50 for every order placed by a friend referred, a tier celebration gift and a birthday gift.Other tier benefits and rewards can be found by visiting: oatbox.com/en/loyalty



5. O’Gourmet

O’Gourmet status is conferred on those registered O‘CLUB members who earn a minimum of 700 points by spending money on Oatbox products online, by referring friends and by leaving a review on one of the products bought. Members receive a tier celebration gift when they qualify for O’Gourmet. Oatbox may, in its sole discretion, alter, limit, or modify the O’CLUB rules, regulations, benefits, eligibility for membership, or any other feature of the O’Gourmet tier or may terminate the O’Gourmet tier at any time in its sole discretion, without prior notice, 

As part of the tier benefits, O’Gourmet members receive $3.00 for every order placed by a friend referred, a tier celebration gift, a birthday gift and various discounts. Other tier benefits and rewards can be found by visiting: oatbox.com/en/loyalty

 

6. O’VIP

O’VIP status is conferred on those registered O‘CLUB members who earn a minimum of 1300 points by spending money on Oatbox products online, by referring friends and by leaving a review on one of the products bought. Members receive a tier celebration gift when they qualify for O’VIP. Oatbox may, in its sole discretion, alter, limit, or modify the O’CLUB rules, regulations, benefits, eligibility for membership, or any other feature of the O’VIP tier or may terminate the O’VIP tier at any time in its sole discretion, without prior notice.

As part of the tier benefits, O’VIP members receive 4.00$ for every order placed by a friend referred, a tier celebration gift, a birthday gift and various discounts. Other tier benefits and rewards can be found by visiting: oatbox.com/en/loyalty



7. Tier Celebration Gifts

Tier celebration gifts have no cash value and can only be redeemed for Rewards. Points are never redeemable for cash, for gift cards or for e-gift certificates and cannot be used as payment. 

The tier celebration gifts are redeemable online in Canada and in the U.S. with any merchandise purchase. Limit one celebration gift per person, per tier. Offer is non-transferable or exchangeable. Offer subject to change, alteration, or termination by Oatbox in its sole discretion at any time. 

No points will be deducted from your account for the reward.



8. O’CLUB Birthday Gifts

 

All O’CLUB members are eligible to redeem one Birthday Gift per year during the month of their birthday. Birthday Gift options may vary by status. To redeem online, a merchandise purchase is required. Log into your Oatbox account and you will be able to add the gift to your box. Contact customer service at info@oatbox.com for support in redeeming your Birthday Gift. Valid while supplies last. The Birthday Gift offer is subject to change, alteration, or termination by Oatbox at its sole discretion at any time.



9. Order Cancellation

O’CLUB Rewards are shipped with product orders. The order has to be at a minimum of $20.00. If your order is cancelled, any O’CLUB reward will not ship because a merchandise purchase is required. If part of your order is cancelled, the O’CLUB reward in your order will ship with the rest of your merchandise order as long as the total amount is above $20.00. 

 

10. Point expiration

It's our hope that you redeem your points on a regular basis. All unredeemed points shall expire when a O’CLUB program member has not engaged in point activity associated with that membership account (through purchase or redemption) for 12 months. If you have questions regarding the date of your last point activity or your last purchase, you may email Customer Service at info@oatbox.com for more information.

In addition, points will automatically expire if your Membership is revoked or otherwise cancelled.

 

11. Agreeing to Oatbox's Privacy Policy & Email

Oatbox values your privacy. BY SUBMITTING AN APPLICATION FOR MEMBERSHIP IN THE PROGRAM, YOU AGREE (OR, IF YOU ARE A MINOR, YOUR PARENT OR LEGAL GUARDIAN AGREES) TO BE BOUND BY OATBOX'S PRIVACY POLICY AND TERMS OF USE. PLEASE SEE OATBOX'S PRIVACY POLICY AND TERMS OF USE AT WWWOATBOX.COM.

If you apply for Membership in the O’CLUB Program, the personal information collected from you will be used and disclosed by Oatbox as indicated in its Privacy Policy and Terms of Use. It will be used only to administer the Program, for internal analysis and to help Oatbox communicate with you by email or direct mail (unless you have unsubscribed from email or direct mail from Oatbox). 

 

12. Communications with Oatbox

By submitting an application for Membership in the O’CLUB Program, you agree (or, if you are a minor, your parent or legal guardian agrees) to receive advertising, marketing materials and other communications from Oatbox. By signing up to join the O’CLUB Program, you will automatically be subscribed to receive O’CLUB Program emails.

 

13. Changes, Termination And/Or Removal From Program

Oatbox may, in its sole discretion, alter, limit, or modify the Program rules, regulations, benefits, eligibility for Membership, or any other feature of the Program (including assigning any of its obligations to customers under the Program at any time to another person or entity, without recourse) or may terminate the O’CLUB Program at any time at its sole discretion, by posting any such changes on the Oatbox website. For Quebec users: Where required by law, Oatbox will send you a written notice of these changes, within 90 to 60 days prior to the effective date of the change, setting out the amended terms and the date of the coming into force of the amendment.

YOUR CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING SUCH CHANGES CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES.

Oatbox reserves the right to exclude individuals from the Program or remove points from a member's account in its sole but reasonable discretion. In particular, any abuse, manipulation or "gaming" of the O’CLUB Program or its rules (as determined by Oatbox), failure to follow any terms of the O’CLUB Program, Membership inactivity for more than 12 months, any misrepresentation or any conduct detrimental to the interests of Oatbox not otherwise protected by law may subject members to Membership revocation or deduction of points obtained through these abusive or manipulative activities and will affect eligibility for further participation in the Program. Membership is non-transferable and Membership purchases must be made by the member. If your Membership is revoked or otherwise cancelled, any points in your account will automatically expire. Oatbox reserves the right to make changes to its Website and these Terms at any time. It is your responsibility to check or review these Terms from time to time to keep informed of any changes. By joining the Program, you hereby agree to be bound by any such changed Terms.

 

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OATBOX WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION OR MEMBERSHIP IN THE PROGRAM, INCLUDING DAMAGES ARISING OUT OF CHANGES TO OR TERMINATION OF THE PROGRAM. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES. TO THE EXTENT PERMITTED BY LAW, THE LIMITATIONS ON OATBOX’S LIABILITY SET FORTH HEREIN SHALL APPLY WHETHER FOR BREACH OR REPUDIATION OF CONTRACT, OR WHETHER IN TORT, CIVIL LIABILITY BY WAY OF NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BY AGREEING TO THESE TERMS, YOU WILLINGLY AGREE (OR, IF YOU ARE A MINOR, YOUR PARENT OR LEGAL GUARDIAN WILLINGLY AGREES) THAT YOU HAVE RELINQUISHED YOUR RIGHT TO SEEK THESE DAMAGES FROM OATBOX  AND THAT THIS IS A REASONABLE ALLOCATION OF RISK. THIS PROVISION DOES NOT APPLY TO NEW JERSEY RESIDENTS.

 

15. Resolving Disputes

If a dispute should arise between you and Oatbox, we want to provide you with a resolution that is efficient and cost effective by using our customer service team. Almost all customer service disputes can be resolved to the customer's satisfaction by using our customer service, reachable by emailing Customer Service at info@oatbox.com.

If your dispute cannot be resolved using our customer service team, these Terms describe how we shall proceed with the resolution of the dispute.

TO THE EXTENT PERMITTED BY APPLICABLE LAWS, YOU AND OATBOX  AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE PROGRAM MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

16. Choice of Law/Forum Selection

The laws of the Province of Quebec shall govern these O’CLUB Program’s  Terms and Conditions. Member hereby expressly consents to exclusive jurisdiction and venue in the courts located in Quebec for all matters arising in connection with these Referral Program Terms and Conditions or Member’s participation in the Program.
